§ 1. Severability Clause.

If any provision of this Code, or the application thereof to any person or circumstance, is held invalid,

such invalidity shall not affect any other provision or application of this Code which can be given effect

without the invalid provision or application, and to this end the provisions of this Code are severable.

COMMENT: Section 1.05 adds a severability clause to this Code and covers this Code plus all amendments thereto. While

no such clause was placed in the former Penal Code, the courts have assumed its existence by case law.
