§ 2945.53.

In all cases in which depositions are taken by the state or the accused, to be used

by or against the accused, as provided in sections 2945.50 to 2945.52, inclusive, of the Revised Code , the court shall by proper order provide and secure to the accused the means and

opportunity to be present in person and with counsel at the taking of such deposition,

and to examine the witness face to face, as fully and in the same manner as if in

court.  All expenses necessarily incurred in the securing of such means and opportunity,

and the expenses of the prosecuting attorney in attending the taking of such deposition,

shall be paid out of the county treasury upon the certificate of the court making

such order.
