licensed under this chapter presents a danger of immediate and serious harm to the

public, as determined on consideration of the evidence by the president and the executive

director of the board of nursing, the president and director shall impose on the individual

a summary suspension without a hearing.  An individual serving as president or executive director in the absence of the president

any appeal filed under section 119.12 of the Revised Code .  If the individual subject to the suspension requests an adjudication, the date set

for the adjudication shall be within fifteen days but not earlier than seven days

after the individual makes the request, unless another date is agreed to by both the

individual and the board.  The summary suspension shall remain in effect, unless reversed by the board, until

a final adjudication order issued by the board pursuant to this section and Chapter

119. of the Revised Code becomes effective. The board shall issue its final adjudication order within ninety days after completion

of the adjudication.  If the board does not issue a final order within the ninety-day period, the summary

the individual subject to the suspension.  If the individual is notified and either fails to request an adjudication within

the time periods established by Chapter 119. of the Revised Code or fails to participate

in the adjudication, the board shall enter a final order permanently revoking the

person's license or certificate.
