§ 4957.13.
If at the expiration of three months from the passage of the ordinance referred to
in section 4957.12 of the Revised Code , the railroad company has refused or failed to co-operate in the preparation of plans
and specifications, or if the engineer of the municipal corporation, or engineer designated
in such ordinance by the legislative authority of the municipal corporation, and the
company fail to agree upon the plans and specifications for such improvement, then
either the company or municipal corporation may submit the matter of determining the
method by which the improvement shall be made to the court of common pleas having
jurisdiction in the county in which the municipal corporation is situated.
