§ 5505.58.
(A) A member participating in the deferred retirement option plan who qualifies for disability
retirement under division (B)(1) of section 5505.18 of the Revised Code shall elect to receive one of the following: (1) The applicable pension provided for in section 5505.53 of the Revised Code , plus any amounts that have accrued under section 5505.54 of the Revised Code to the member's benefit under the deferred retirement option plan. (2) The disability pension provided for by division (B)(1) of section 5505.18 of the Revised Code . Acceptance of a disability pension requires forfeiture of all amounts accrued under section 5505.54 of the Revised Code to the member's benefit under the deferred retirement option plan, and those amounts
shall be treated as if the member had continued in the active service of the state
highway patrol and not participated in the plan. The member shall be granted service credit for the period the member was participating
in the plan. (B) A member participating in the deferred retirement option plan who qualifies for disability
retirement under division (B)(2) of section 5505.18 of the Revised Code shall receive the applicable pension provided for in section 5505.53 of the Revised Code , plus any amounts that have accrued under section 5505.54 of the Revised Code to the member's benefit under the deferred retirement option plan.
